I sent a request for everyone to help us with this petition drive, please follow the links and help us let our elected officials know how we feel about the abuse of eminent domain. If any other petitions show up, either uncheck them or ignore them. I have not had this issue before, and next time I will look for a different site.

There is a Virginia  Constitutional Amendment on the ballot on Nov. 6th that will affect the property rights of citizens all over the Commonwealth. A vote of "YES" will protect citizens from land grabs and "close the loopholes in Virginia law that are the result of the Kelo decision". 

Citizens want a resolution from the Board of Supervisors. Will they go on record supporting the constitutional rights of citizens and the end to governmental land grab and abuse?

We have placed two on line petitions, one for York County and one for James City County which will be presented to the Board. Please support our efforts.

We the under signed citizens request the Board of Supervisors adopt a resolution supporting the  amendment to the Constitution of the Commonwealth of Virginia, which will appear on the ballet  on Nov. 6th following suite with numerous counties across the state in support of the eminent domain amendment.

Whereas, this country was founded on the principal of private property rights and this has become an important aspect of the American dream; and

Whereas, the Supreme Court of the United States has indicated that the use of eminent domain laws are a States' rights issue; and

Whereas, the government taking of privately owned property should be limited to the need for public use projects only; and

Whereas, citizens should be adequately compensated when their property is taken for government use including loss of use and/or income; and

Whereas, both the House of Delegates and the Senate of the Commonwealth of Virginia has twice passed an amendment to the Constitution of Virginia regarding eminent domain; and

Whereas, the constitutional amendment will be on the November 6, 2012 ballot for approval by a majority of voters in Virginia

Now, Therefore Be It Resolved That, the James City County Board of Supervisors does hereby support this constitutional amendment restricting the use of eminent domain in the Commonwealth and encourages its citizens to vote yes on the ballot in November.

A Letter

Because of the current political debate regarding in which political direction the country should go, I wanted to know if our children were being taught about our Founders' concept of governance and what that reality is today. I placed the question, in the context of the 17^th Amendment, before my county's High School. The answer; our children are not being taught the real life political impact of this fundamental change Amendment.

            I was not surprised. I had talked with too many intelligent adults who had no idea what I was talking about. The High School Government Courses are being taught in accord with the Standards of Learning prescribed by the Commonwealth of Virginia. But, today's significance of actions a hundred years ago is also relegated to the dust bin of history.

            The 17^th Amendment destroyed the Founders' concept of the Sovereign States as the counterpoint to the Central Government. The Senate was the instrument for constraining the power of the Central Government. The national political parties liked the 17^th Amendment because it allowed the political debate to move from between the Central Government and the Sovereign States to a campaign between the two political parties which these national entities could control. If you believe that your Senator cares about your opinion, write him. See what you get back. Today, the political debate is between Democrat and Republican politicians competing for the center chair of an all-powerful unconstrained oligarchical Central Government.

            How can we expect our children to honor our exceptional national heritage, if we do not insure that they know and understand the foundations of that heritage?

I hope you & your family are doing well and your wife is well on her way to getting back on her feet.  

I have a few questions regarding the new recycling fees being discussed by the BoS.

The letter from the County Administrator to the BoS proposes an increase in the monthly solid waste fee from $12.25 to $18.50.  Today's Daily Press says $5 of the increase is for recycling while the rest is for "an increase in costs associated with curbside pickup".  The County Administrator's letter makes no mention of any other costs, although it does mention tracking participation in the recycling program and a rewards program if a "certain level of participation is achieved".  However, the Daily Press article also mentions a cost of $24 per month if we choose not to participate in the recycling program.

Given that York County residents "voted" overwhelmingly with their hard earned dollars to NOT participate in the recycling program if left to their own choices, these recent developments immediately raised quite a few questions for me.   If memory serves, something less than 20% of York County households signed up for a revised recycling program when it was offered just a few months ago when the money would have come from our own pockets on top of all other taxes & fees.  I'm sure others will likely have the same questions and (in the interest of full disclosure) I intend to share this email w/ the Tuscany Forum.  So......

Why does the BoS believe the recycling program should be continued in spite of the fact county residents have clearly shown we're not interested in paying for it?  Specifically, why does the BoS feel it is the citizen's best interest to be overridden by the BoS in this matter?

Who specifically came up with the idea to charge residents $24 per month if we choose not to participate?  Again, this fee was not mentioned in the County Administrator's letter to the BoS.  Quite frankly, this proposal appears to be the York County version of ObamaCare - you will pay because Big Brother says you will regardless of whether you want or need the service.  And if you don't need or want the service we're going to penalize you.

What level of participation is required before the rewards program kicks in?  What is the cost of this rewards program?

Why do York County citizens who already pay for weekly trash pickup by the County have to pay $5 per month for recycling while people who pay for private trash pickup only have to pay $4 per month for recycling?

Why does the County Administrator believe it is necessary to track each household's participation in the recycling program?  Will this tracking system be used to penalize residents who pay for recycling but don't actually participate in the program?  What is the TOTAL cost of this tracking system to include software, personnel, and any other administrative costs?  Please see above reference to Big Brother.

Why can't York County simply let the current recycling contract expire as scheduled and eliminate the program or find another contractor who is willing to take the recycled materials and sell them as they desire to pay for the program?  

I remain concerned about the level of spending and bureaucracy in our County Government.  The consistent claims from the BoS of poverty and inability to adequately support existing infrastructure or take care of employees while it continues to spend money on luxuries (such as the $2.87M 1.5 mile long bike path) is falling on deaf ears.

If the BoS hears anything please hear this - we're tired of ever rising taxes and fees at all levels of government.  The only ones getting raises these days is the government and that's a problem.  York County doesn't have a tax problem - it has a spending problem.
